EXECUTIVE ORDER NUMBER 46


WHEREAS, this Administration believes that Alabamians are entitled to full and complete information regarding how their hard-earned tax dollars are being spent by state government and they should have easy access to that information; and

WHEREAS, bringing transparency into state government spending will lead to more accountability for the taxpayers of Alabama and would allow the State of Alabama to benefit from increased competition because potential state contractors could easily review the relevant aspects of existing state contracts; and

WHEREAS, shining a light on government spending and making that information easily accessible is particularly important for taxpayers today. Alabama has made strides to achieve accountability but much work remains, further creating a need to be more cautious of how every state dollar is spent; and

NOW, THEREFORE, based upon these considerations, and for other good and valid reasons that relate thereto, I, Bob Riley, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do direct the Comptroller’s Office to establish a database of state expenditures, including contracts and grants, that are easily accessed by the public; and

BE IT FURTHER ORDERED, that the Finance Department shall develop and operate a website accessible at no cost to the public, which provides up-to-date information regarding the expenditure of state funds of all appropriated or non-appropriated funds by a state agency in forms including, but not limited to, grants, contracts, and subcontracts.

(1) The Finance Director shall require all agencies to report expenditure data to the Comptroller’s Office to include, but not be limited to:

(a) The amount of funds expended;

(b) The date of the expenditure;

(c) The expending agency;

(d) The budget funding source; and

(e) Any other relevant information specified by the Comptroller’s Office.

(2) The Comptroller’s Office shall report and post these expenditures on a monthly basis.

(3) The Comptroller’s Office shall continue to enhance the level expenditure detail and the efficiency of the website as the SMART Business Systems Financial System continues to become implemented by all state agencies.

The website portal must be online no later than March 1, 2009, for expenditures monthly incurred in the 2008 fiscal year and for monthly reporting of expenditures incurred in the 2009 fiscal year. The searchable feature of this website must be in

operation no later than September 1, 2009. All agencies of state government shall provide to the Comptroller’s Office any information requested by that Office that is necessary to accomplish the purposes of this Executive Order.

BE IT FURTHER ORDERED that this Executive Order shall become effective immediately upon its execution and shall remain in effect until amended or modified by the Governor.
